CLAAS Statement on Gray Market Machines

This statement addresses when a third party, other than CLAAS of America Inc. (the CLAAS Sales Company), imports CLAAS machines into the North American market or when a CLAAS dealer or CLAAS Sales Company is requested to sell a machine cross-border, i.e. outside the country where the dealer or CLAAS Sales Company is located.*

Machines involved in such cross-border sales are known as gray market machines. Gray market machines produced for other markets can differ significantly from that which a CLAAS dealer and end-customer would purchase via the CLAAS Sales Company. These machines may not fulfill the mandated requirements of the market into which they are imported. Requirements not fulfilled by gray market machines may include, but are not limited to, any of the following examples:

  • Emission regulations
  • Maximum speed levels
  • Safety decals
  • Lighting
  • Tires
  • Operators Manuals
  • General homologation issues

Customers buying such gray market machines may face non-acceptance/embargo by authorities and/or be required to adjust such a machine so it would meet the requirements. This may be technically impossible in some cases.

*This statement does not apply to CLAAS machines sold between the United States and Canada. The United States and Canada observe the same requirements and machines may pass freely between the two countries.

Neither CLAAS of America Inc. nor any CLAAS dealer will provide parts, service or warranty support for any CLAAS gray market machine. The gray market machines will not be eligible for Performance Improvement Programs (PIPs) nor any other warranties including EPA emissions warranties. CLAAS of America Inc. accepts no responsibility for gray market machines whatsoever.
